2. Notice of claimed infringement
To submit a notice under 17 U.S.C. § 512(c)(3), provide a written communication that includes:
- a physical or electronic signature of a person authorized to act for the owner of the exclusive right that is allegedly infringed;
- identification of the copyrighted work claimed to have been infringed, or a representative list of works at a single site;
- identification of the material claimed to be infringing, with information reasonably sufficient to permit Dials to locate it;
- your contact information, including address, telephone, and email;
- a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act for the owner.
Notices that do not substantially comply with the rule may not be effective and Dials may not be obligated to act on them.
3. Counter-notice
If material was removed by mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g) that includes your signature, identification of the material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and your contact information and consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, to a court in Delaware).
4. Repeat infringers
Dials terminates the accounts of users and Customers who are determined to be repeat infringers under appropriate circumstances. Three substantiated DMCA notices within a twelve-month period, or a single act of egregious infringement, may result in termination.
5. Misrepresentation
Any person who knowingly materially misrepresents under § 512 that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).
